Problems of criminal legal assessment of the falsification of investigative activities results

The falsification of investigative activities results is a relevant issue due to its recent identification as a special element of crime stipulated in Part 4 of Article 303 of the Criminal Code of the Russian Federation. The study defines the main problems of the elements of crime under review demonstrating its wide opportunities for optimizing the legislation. The range of problems includes the literal interpretation of the concept of falsification, understanding the criminal intent, its correlation with other elements of crime, the ratio between form and contents of investigative activities results obtained, getting information from confident informants. The author proposes the revision of Part 4 of Article 303 of the Criminal Code of the Russian Federation extending its scope according to objective and subjective aspects. It is concluded that the contents have the priority over the form of investigative activities in line with the attitude of the Supreme Court of the Russian Federation towards certain criminal investigations.
