Problems of unification of the concept of serious harm to health in Russian criminal law: questions of theory and practice

Modern Russian criminal legislation is characterized by a multiplicity of crimes involving responsibility for causing serious harm to health. However, the lack of a unified approach to the definition of this concept creates significant problems in law enforcement practice. The study reveals contradictions in the legislative regulation of various types of crimes against health, analyzes the criteria for distinguishing serious harm from other categories of damage, and examines the specifics of the qualification of reckless crimes and threats of harm to health. The work is based on an analysis of the theoretical provisions of the domestic science of criminal law, judicial practice and foreign experience of legal regulation. The directions of improving legislative structures and unifying approaches to the definition of serious harm to health in various types of crimes are proposed.
