The article focuses on the complex issues of compensation for damage in the criminal process of the Republic of Kazakhstan, emphasizing the importance of legal regulation and the need for compensation mechanisms to protect the rights and interests of citizens. The author highlights the limitations of existing approaches to the interaction between law enforcement agencies and citizens, especially in the context of pre-trial investigation, where the actions of law enforcement agencies can lead to violations of individual rights. The author points out the need to adjust national legislation in the field of compensation for damage caused by both illegal and legal actions in criminal proceedings. The importance of creating an effective system of compensation for violations of the constitutional rights of participants in legal proceedings and the adoption of legislative acts that would comply with international standards for the protection of human rights is voiced. In conclusion, the author calls for an interdisciplinary approach to the study of issues of compensation for damage and increased responsibility of law enforcement agencies for their actions, emphasizing the critical need for comprehensive research and the development of new methodologies to address this pressing issue.
