The issue of choosing the legal structure of the voluntary people’s patrol

The voluntary national team is considered as a version of the non-profit organization created in the form of public association. Signs of legal status of the voluntary national team are revealed, allowing to delimit it from other public associations. Separate problems of restriction of right ability of the specified version of legal entities are designated from government bodies and local governments. In particular the Law on public associations fixes inadmissibility of intervention of public authorities and their officials in activity of public associations and vice versa, impossibility of performance of public authorities and local governments as founders, members and participants of public associations. The impossibility of restriction of the rights established by the law or freedoms of citizens depending on their not belonging to public associations is specified by the author as one more discrepancy of the legislation to the legal nature of a voluntary team. The author comes to a conclusion that the most suitable form of public association for creation of such organization as «A voluntary national team» this state and public association. The author assumes that in a case with the public and state associations the state has to delegate to constantly operating executive body of association of officials (the representatives). In a case with state and public associations, the state has to preside at association activity by creation of the specialized government bodies (structures) which are directly acting as governing bodies of association. Such associations are created any more at the initiative of citizens, and at the initiative of the interested public authorities by adoption of the relevant regulations. Suggestions for improvement of the civil legislation are formulated.
