Procedural rights and duties of expert in civil legal proceedings

Purpose: Research of procedural rights and duties of the expert. Methodology: The author used formal legal method, and also the comparative analysis of the legislation regarding procedural laws and the expert’s duties. Results: In article the conclusion is drawn on need of improvement of the Russian legislation concerning legal status of the expert regarding specification of the concept «need», reduction in compliance of sequence of categories of «right» and «duty». The conclusion is drawn on expediency of distribution of the right of expression of a dissenting opinion of the expert provided (item 2 of Art. 83 of the Civil Code of the Russian Federation) and on the conclusion of complex examination (Art. 82 of GPK Russian Federation). Novelty/originality/value: Article has a certain scientific and practical value as in it the analysis of actual legislative and law-enforcement problems is made.
