Examining the procedural mechanism of exercising the right of a person to file a lawsuit in court to protect his violated rights and protected legitimate interests, an attempt is made to set out the content and characteristics of the procedural prerequisites for the implementation of this right. Along with the theoretical aspect of the problematic issues under consideration, the position of the highest judicial bodies is set forth as a procedural precedent for resolving the stated procedural conflicts.
