Procedural order: the problem of understanding

In the theory of criminal procedure, the concept of “procedural order” is not defined. The traditional object of research is the separate procedures for the production of procedural actions, the adoption of procedural decisions, fragments of criminal procedural activity. The understanding of the procedural order as a generic concept in relation to specific concepts (the order of inspection, the procedure for conducting a preliminary hearing, others) is not considered in science.The concept of “procedural order” is specific in relation to the concept of “legal order”. To reveal the features of the concept of “procedural order”, an analogy from the theory of I. Prigogine and I. Stengers about the emergence of order from chaos can be used. At the same time, the specific differences of the procedural order are its reliance on the dynamic characteristics of the branch of criminal proceedings, the spatial and temporal structure, the elements of which are interconnected.
