Proposal for a regulation on the access of third-country goods and services to the European Union’s internal market in public procurement: prospects and consequences for Russia

The study examines the amendments to the current legal regulation of public procurement in the EU, particularly the proposal to create a legal instrument regulating the access of third-country companies to the European Union’s market. The research focuses on the draft of a Regulation of the European Parliament and of the Council on the access of third-country goods and services to the Union’s internal market in public procurement and procedures supporting negotiations on access of Union goods and services to the public procurement markets of third countries. The author highlights the necessity to elaborate on the countries’ markets, which are the parties to the system of public procurement, and the present barriers as well as to negotiate with foreign entities for resolving disputes. The relevance of the topic is due to the amendments not only to the legal regulation of public procurement in the EU but also to the influence on market and legal relations in different countries, including the Russian Federation, while implementing this instrument.
