Derivative financial instrument: reflection in the law. The civil law concept or the general legal understanding?

The conditions of the modern regulatory environment are analyzed from the standpoint of a conceptual understanding of the legal nature, characteristics of the legal regime, and understanding of the legal structure of derivative financial instruments. Gaps, contradictions, duplication, and logical ambiguity of legal regulation are revealed. Conclusions are drawn about the possibilities of civil concept forming or other (including intersectoral) reflection in the law of the derivative financial instrument construction.
