Contradiction of illegal migration and illicit trafficking in human beings: protection of human rights and citizen and public interests of the state (international aspect)

In this article the authors analyzed the Protocol against the Smuggling of Migrants by Land, Air and Sea and the Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children, supplementing the United Nations Convention against Transnational Organized Crime. The reasons for the refusal of Russian and foreign lawmakers to implement into national legislation the provisions of the Protocol against the importation of migrants are explored, and the grounds for distinguishing between the concepts of “smuggling of migrants” and “trafficking in persons” are given in the absence of obvious consent to transboundary movement.
