Public and private law principles in the administrative contract

The authors make an attempt to summarize viewpoints of Russian scientists on the role and place of an administrative agreement in order to prove the need for self-regulation of the legal institution under consideration. The presence of private and public law principles in administrative contracts confirms the specificity of such agreements, its individual legal nature. The given by the authors criteria enable one to determine whether one or another contract belongs to the private or public law. The process and the result of such identification is an important component, as a treaty itself as a legal fact entails strictly defined legal consequences.
