The article discusses the legislative innovations of 2018, which significantly transform the institution of public easement in Russian law. The author reveals significant gaps in the legal regulation of easements, which seriously complicates the acquisition of such rights for construction purposes. It analyzes the basic conditions for establishing a «public» easement according to the new rules and the mechanism for recovering losses to the owner of a land plot burdened with such an easement. Indicates the need to amend the Civil Code of the Russian Federation and coordinate it with the adopted short stories.
