Ways to improve the legal regulation of confiscation of property in the prism of legal technique

In this article the author carries out a comparativist analysis of the state of confiscation of property in domestic criminal law, as well as in the criminal law of foreign countries in the prism of legal and technical aspect. Positive moments, optatively subject to prescription in the current legislation of the Russian Federation are emphasized. It is pointed out the shortcomings of legislative technique in the issue of the institute of confiscation of property, the decisions of law enforcement (if any), as well as representatives of the doctrine are given in this regard. The reserves for optimization of regulation of the sought institute of law are determined and the ways of solution are offered.
