Expanding the powers of the court in criminal pre-trial proceedings as a trend in the development of modern justice

The article is devoted to the urgent problem of domestic criminal procedure science, associated with the definition of the essence of judicial activity in pre-trial proceedings. The article substantiates the position that this activity has constructive signs of justice. It is argued that the significant directions of improvement of criminal procedural legislation at present are the expansion of the powers of the court, strengthening of judicial power in the sphere of criminal proceedings, recognition of judicial control as the most effective way to resolve conflicts arising in pre-trial proceedings, ensuring the legality of restriction of constitutional rights of the individual. On the basis of comparative legal analysis of the current CPC of the RF and codified acts of the Soviet period the thesis that the powers of the court in pre-trial proceedings are constantly increasing is argued.
