Judicial consideration of materials on the restriction of constitutional rights of citizens in the course of operational search activities. Fundamental problems

The legislation regulating the procedure of judicial consideration of materials restricting constitutional rights of citizens in the conduct of operational search activities is analyzed in the article. The author gives the reasons to conclude that under the current legislation courts have no legal capability to consider materials on the restriction of constitutional rights of citizens. Some changes to the legislation, aimed at eliminating the identified problem are proposed in the article.
