Division of joint property in case of bankruptcy of one of the spouses

This work is devoted to the study of topical issues arising from the division of joint property of spouses in the framework of the bankruptcy procedure of one of them. The article considers the specifics of determining the composition of common property, the creditors' rights to the debtor's share, as well as the problems of protecting the interests of a bona fide spouse. The various approaches of judicial practice to resolving disputes related to the division of joint ownership in bankruptcy are analyzed, and recommendations are made to optimize the procedure in order to ensure a balance of interests of all participants in the process. Special attention is paid to the analysis of recent changes in legislation and their impact on the practice of applying the rules on the division of property.
