Division of authority between the federal executive authorities of the Russian Federation in the field of environmental protection: the main problem

The article sets out the basic problem of delimitation of powers between the executive power in the sphere of environmental protection have been identified and summarized their causes. According to the author, this analysis is needed for further study of distribution of powers between levels of government in the field of the environment and their role in the implementation of the constitutional rights and civil rights to a healthy environment. Since the early 90-ies of XX century to the present, the system and structure of federal executive bodies has undergone numerous changes. In this case, for nearly two decades, the main purpose of the administrative reform is to streamline public administration by simplifying the structure and reducing the staff of the executive authorities of the Russian Federation. During this time, the legal status of the federal bodies of executive power has changed several times. Corresponding changes were also made, and their names, lines of authority and their areas of jurisdiction. Certainly, there have been changes in the distribution of powers. The effective separation of powers between the different levels of public administration is one of the most important and deeply practical problems of the present stage of development of the Russian state. Unfortunately, the system of state environmental management is now characterized by the incomplete process of separation of powers in the environmental field as between the federal authorities and between the federal authorities and the state authorities of the Russian Federation, which makes it inefficient and not effective [8]. Among the many problems in the joint jurisdiction of the Russian Federation and its special place in matters of legislation on environmental protection. Everyone's right to a favorable environment, reliable information about its condition and compensation for damage to health or property by ecological violations enshrined in the Constitution of the Russian Federation, and depends on the effective implementation of the constitutional law on the federal and regional level. Analysis of the administrative reform in the public administration over the past two years suggests that the functions in the field of environment and natural resources are not concentrated in a single agency. The criteria of differentiation designated authority still raise some questions. Public administration use and protection of natural resources of the various governmental bodies with different expertise and operating at different levels. They can be divided into three types: the organs of general competence, the organs of special competence, functional organs.
