Emergency military legislation in modern legal reality embodies a set of legal norms that begin to take effect only when specific legal facts occur, such as the beginning of hostilities or as a threat of real aggression against the state. These normative legal acts regulate all the activities of the state, starting from the classification of threats falling under the law, and ending with the rights and obligations of subjects who may be involved in an armed conflict. In this situation, it acts as one of the main levers in the mechanism of ensuring the country’s defense capability, as well as a guarantee of respect for individual rights, including when establishing the necessary restrictions, both in the initial period of the armed conflict and during periods of its escalation.
