The Development of the Legal Framework for Ensuring State Security in Russia: A Retrospective Analysis

In modern conditions, ensuring state security of the Russian Federation has become particularly relevant. An important prerequisite for raising its level is proper legal regulation of relations in this area. The improvement of legislation in the field of state security is possible, including through the use of existing national experience. Purpose: to analyze the development and current state of the legal framework for ensuring state security in Russia, to formulate conclusions and proposals that can be used to improve it. Methods: historical and comparativelegal, formal-legal. Results: the study establishes that the term “state security” dates back to prerevolutionary legislation. During the Soviet period, it became widespread. Much attention was paid to the legal regulation of relations in the area of state security in the USSR, and a number of regulatory documents issued by various authorities were devoted to this. The current legislation of the Russian Federation in the area of state security contains a number of provisions similar to those that w ere enshrined in the acts of the USSR. One of the main problems in regulating these relations at the present time is the lack of a legal definition of the term “state security”. Its normative consolidation will make it possible to distinguish between the concepts “state security” and “national security”, will contribute to improving the level of state security.
