Realization of constitutional values in the field of bankruptcy

This article discusses the implementation of the fundamental and guiding legal principles and universal benefits enshrined in the Constitution of the Russian Federation within the framework of the legislation that implements legal regulation in the field of bankruptcy (insolvency). The relevance of the study is justified by disputes about the constitutionality of bankruptcy norms. The relevance of the study is justified by the long-standing disputes about the constitutionality of certain provisions of bankruptcy legislation, so the author considers the normative-legal regulation of this issue through the prism of basic goods and values contained in the Constitution of the Russian Federation. By comparing the fundamental rights and freedoms of man and citizen and normative-legal acts regulating in the field of insolvency, as well as the positions of the scientific community, the author concludes that the legislative regulation of bankruptcy complies with the basic provisions of the Russian Constitution, respects and observes the rights and freedoms of man and citizen in various procedures applied in bankruptcy proceedings.
