Implementing the joint competence principle in subsurface resources management

The paper covers the mechanism of implementation of the joint competence principle in the subsurface resources management. The current version of the "Subsurface " regulations does not reveal the mechanism of implementation. The worldwide practice of the joint competence in subsurface resources management is the subject to jurisdictions division connected with the resources ownership. The Constitution of Russian Federation, in its part of the "Subsurface" regulations, announces the resources ownership. However, the order of resources sites distribution either to the federal or any other ownership is not developed. Besides, there are no legal frameworks for both the use conditions in changed geological or other characteristics of the sites and the assessment of professional competences in the subsurface resources management. The jurisdictions division of powers seems a false implementation of the joint competence principle in the subsurface resources management because it has resulted in absence of information about the mineral resources sector as a major source of the Russian budget incomes.
