Recidivism of foreign citizens on the territory of Russia: socio-legal characteristic

The article provides information on the phenomenon of non-Russian ethnic crime, which is characterized by organization, weapons and sustainable links with criminal communities from their countries of arrival, causes the internationalization of Russian crime; Illegal migration of foreign nationals, which contributes to quantitative and qualitative changes in the general criminal situation in the country; The emphasis is placed on the fact that the socio-economic situation of the population of part of the former countries of the USSR and other States neighbouring Russia continues to deteriorate, which causes various conflicts and increased flows of their citizens to the territory of our country in search of work, study and political asylum; The task of justifying the legal nature of illegal migration is being addressed; The arguments of the necessity of timely identification of foreign citizens prone to recidivism are determined, followed by registration of them with the internal affairs agencies, taking into account other information systems of operational-search, criminological, preventive and reference purpose. The paper shows the content and main causes of recidivism of foreign citizens, their social danger and gaps in the criminal policy of Russia; There is a theoretical and legal justification for the categories “dangerous recidivism,” public danger of the offender “; The most important socio-demographic and moral-psychological characteristics (indicators) for studying the identity of a migrant recidivist, for which a portrait of the average foreign offender is drawn up; It is proven that such recidivism is a systemic factor contributing to terrorism, extremism, illicit proliferation of weapons and drugs. The theoretical discussion of the problem is illustrated by the results of empirical studies. The work proposes practical recommendations on the institutional support of law enforcement agencies, their consolidation in the fight against organized international crime, and makes concrete proposals for improving criminal legal measures to counter recidivism of foreign citizens.
