Regional legislation on the protection of human and civil rights and liberties as an important area of judicial regulation control (in the light of the practice of the Constitutional Court of the Russian Federation)

Based on the practice of the Constitutional Court of the Russian Federation the article analyzes the problems of judicial regulation control over regional legislation on the protection of human and civil rights and liberties; substantiates the constitutional nature of the problems arising in this connection, primarily related to the distinction of federal and regional powers in this field. On this basis, the conclusion about the preferability of constitutional regulation control in relation to administrative judicial regulation control over such laws of the constituent entities of the Russian Federation is made. Constitutionally significant defects of regional legislation in the area of protection of human and civil rights and liberties are revealed.
