Risks associated with ethical aspects of professional activities of an advocate in scientific works of foreign researchers: highlights and interpretations

In the article the author analyzes scientific works of foreign researchers in the field of professional ethics of an advocate. The author identifies and considers four theses widely discussed in scientific circles: the necessity to consider issues of professional ethics «in the context», taking into account all the facts and circumstances; the existence of ethical «blind spots» at both individual and organizational levels; the identification of three factors that may cause unethical and unlawful conduct of an advocate in the provision of qualified legal assistance; the existence of three fundamental conceptual dichotomies of legal ethics that may influence the understanding and possible solutions to fundamental ethical issues of representing the interests of principals.
