The role of the judicial power in the implementation of the constitutional principle of separation of powers in the budget process of the Russian Federation

The article deals with the role of the judicial power bodies in the budgetary process through the prism of the implementation of the constitutional principle of separation of powers. By comparing the budgetary powers of government legislative and executive authorities, the role and functional purpose of the judiciary in the budget process is determined. Based on the analysis of the decisions of the Constitutional Court of the Russian Federation and judicial practice, a necessary sign of the implementation of the constitutional principle of separation of powers in the normative regulation of the budget process is revealed - legal certainty, which implies compliance with the requirement of unambiguity and clarity of regulatory procedures within the framework of the budget process.
