Purpose: Investigation of the role of the court in criminal procedure proving. Methodology: The author had applied rather-legal and legalistic methods. Results: The article identifies ways to ensure fairness in the criminal process. Particularly important for the protection of human rights and fundamental freedoms is the role of the court in proving. Authentic knowledge of the event a criminal offense is a prerequisite to the court equitable solutions. The adversarial principle in criminal proceedings requires the Court to create the necessary conditions for the implementation by the parties of their procedural rights and fulfill procedural obligations. The Court cannot be a passive observer of the procedural opposition parties. The responsibility of proving in terms of control and estimation of evidence rests with the judge in accordance with the law and it is his a moral duty. Novelty/originality/value: The article presents scientific and practical value as containing generalizations and conclusions of the author, description of the concepts of «evidence» and «proving» in the criminal process of Ukraine. The necessity of organizing manifestations role of the court in considering each individual criminal case. The court should create the necessary conditions for the establishment of truth and justice, without interfering in the match of the parties.
