The role of the judiciary in John Lilburn’s concept of separation of powers and its reflection in the modern state

The article is devoted to the analysis of John Lilburn's concept of separation of powers and its reflection in the structure of the modern Russian state. It is emphasized that the concept of Lilburn, put forward during the English Revolution of the XVII century, included such key provisions as a clear division of powers between the branches of government, the independence of the judiciary and the need for its formation by popular will. The author notes that although Lilburn's contribution to the formation of the idea of separation of powers is insufficiently covered in modern research, his key provisions are reflected in the Constitution of the Russian Federation and legislation. The conclusion is made about the prospects for further elaboration of mechanisms for the election of judges, taking into account historical experience and modern realities.
