The system of contracts for the lease of natural resources

Бесплатный доступ

The system of contracts for the lease of natural resources, including the use of subsoil, water bodies, forest and land plots, is considered. A number of common features have been identified, including the differentiation of the right of ownership, depending on the specific method of exploitation, the specification of the boundaries of the object in the contract, due to the unity of a significant part of such resources as a natural complex. The certainty of the purpose or mode of operation of an object when leasing natural resources is imperative; private law principles in this area are limited to combinations of methods for operating the leased object. The method of use in most cases determines the price of the contract, which can be formed taking into account the volume of withdrawal of natural resources. The general requirement for the safety of the leased object in the system of lease agreements for natural resources is specified by special environmental requirements and the establishment of operating modes that make up the allowable use.
