Guaranteeing system for the principle of independence of the courts in criminal proceedings

Introduction: the article is devoted to the analysis of one of the fundamental principles of criminal proceedings in the Russian Federation - the independence of judges. The relevance of the topic is due to the problems of a theoretical, rulemaking and law enforcement nature while ensuring the independence of judges as a principle of criminal proceedings. In this regard, the authors consider it paramount to consider the issue of improving the guarantees of the principle of independence of judges. Materials and methods: the research materials were the norms of domestic legislation governing criminal procedure relations, scientific publications of scientists. The authors used the normative-logical, formal-legal and other scientific methods. Results: an analysis of the empirical base allowed the authors to identify problems (scientific and practical) of ensuring the principle of independence of judges, scientifically substantiate a system of guarantees ensuring the principle of independence of judges. Summary and conclusions: formation of a system of guarantees ensuring the principle of the independence of judges; study of the possibility of real implementation of the guarantees of the independence of judges in modern conditions; the construction of a mechanism for the implementation of guarantees of the independence of judges will contribute to the achievement of the effective implementation of the principle of independence of judges in criminal proceedings.
