Core elements and legal nature of contracts that promote competition on public interest markets

In order to improve the legal regime of market-based private law instruments, the study classifies the contracts that directly regulate entrepreneurial relations in providing public services. The core elements include a unified focus on the integration of social and economic effect contributing to the social problem solution; the integrated multi-sectoral nature; party to the contract that is the state (public-law entity); the subject of the contract, i.e. necessary public facilities or goods. The author concludes that to improve the legislation, differences in regulatory legal regimes of guaranteed and non-guaranteed public interest markets should be taken into account according to the level of state guarantees for the exercise of Russian citizens’ constitutional rights.
