Death of a patient: problems of differentiation of related constituents of the Criminal Code of the Russian Federation

The article is devoted to the issues of distinguishing the categories of the Criminal Code of the Russian Federation in the context of medical assistance, due to the negligence of the patient’s death. The main problems of law enforcement based on judicial practice are analyzed, and attention is focused on specific errors in the qualification of medical workers, which resulted in the patient’s death. It proposes ways of improving the criminal law in the context of the issue under consideration, with a view to reducing the number of cases of misinterpretation of criminal law and subsequently, incorrect legal qualification.
