The article examines the criminal law mechanisms for ensuring public and state security. The most socially dangerous crimes against public safety are crimes related to terrorist activities. Since crimes against public safety pose an increased danger, the categorization of these crimes should be appropriate. In this regard, particularly severe penalties should be provided for the commission of crimes against public safety. It is noteworthy that among the crimes for which the death penalty is provided, there are no crimes against public safety, including a terrorist act. It seems that a terrorist act is no less socially dangerous crime compared to those crimes for which the death penalty is provided. In conclusion, the author concludes that in order to ensure public and state security in the Russian Federation, judging by the available facts, it is likely that the death penalty will be applied in the near future. The list of crimes punishable by death will be expanded to include crimes related to terrorist activities.
