The Russian Federation is a State in which a moratorium on the use of the death penalty has been introduced. The problem is that the duration of the moratorium is not defined. However, the moratorium, according to the authors, can be lifted at any time, which is unacceptable. The article analyzes the need to abolish the death penalty in the Russian Federation and the legislative consolidation of the provision that the Russian Federation has completely abandoned the use of the death penalty as a type of punishment provided for certain crimes, and also, the paper provides multiple arguments in favor of such a refusal. The object of the study is the inalienable right of every person the right to life, which cannot be encroached upon. The aim of this work is to give and analyze the reasons why the state should refuse to lift the moratorium on the use of the death penalty and completely eliminate this sanction. The authors come to the conclusion that the death penalty as a type of criminal punishment for society and the state is an evil that deprives a person of the life granted to him by nature and the gradual abolition of this type of punishment by the state, in particular, by the Russian Federation, is necessary.
