The article considers the punishment in the form of death penalty in Russia. The legal problems on the way of exclusion of the death penalty from the Russian legislation are considered. In addition, the article presents an analysis of the work of Cesare Beccaria. The analyzed work includes a set of arguments proving the inexpediency of this type of punishment
