Compliance With the Rules for Criminalizing an Act and Differentiating Criminal Liability as a Guarantee of Human and Civil Rights

In the presented article, the author proves the influence of the processes of criminalization, construction and differentiation of criminal liability on such constitutional values as the rights and freedoms of man and citizen. The establishment of such a dependence predetermined the requirements for the legislator to comply with certain rules when implementing such processes. In particular, the author proposes to pay primary attention to the validity and timeliness of the criminalization processes. Differentiation of criminal liability is advisable, in the author's opinion, to carry out only with a significant change in the social danger of the identified form of the act. In turn, when constructing the corpus delicti, the emphasis should shift to a reasonable selection of mandatory features, the establishment of which can be carried out in practical activities.
