The social function of property and its modern significance

The article deals with the issue of determining the legal essence of such a category as property. The necessity of moving away from the classical concept of property, which emphasizes the dominance and power of the owner, in favor of its social function is substantiated. The article analyzes the works of representatives of French jurisprudence of the early twentieth century (H. Hayem, E. Marguery, L. Duguit), as well as modern American jurisprudence (G. S. Alexander, C. Crawford, S. R. Foster, D. Bonilla, J. W. Singer) in the field of the social function of property. The conclusion is made about the importance of such ideas in modern conditions and the need for their further development both in the scientific and legislative fields.
