In the article, the author, focusing on the number of crimes in the sphere of economic activity and the harm caused to the state, analyzes the social and practical nature of the application of the investigated criminal law instrument. The criteria for the application of special types of exemption from criminal liability in cases of crimes in the field of economic activity are described and illustrated with specific examples from judicial practice. The author comes to the conclusion that the institution of exemption from criminal liability in cases of crimes in the field of economic activity, being an integral part of criminal policy, acts as means of criminal legal influence
