Social prerequisites for criminal and legal regulation of negligence (article 293 of the Criminal Code of the Russian Federation)

The article deals with social conditionality of establishing a criminal law ban for negligence (article 293 of the Criminal Code of the Russian Federation). It is indicated that the study of the social conditionality of criminal liability for negligence allows to determine the reason why the legislator criminalized this norm. Scientific approaches to the problem of determining the grounds for criminalization are analyzed. It is proposed to consider the social danger of negligence as the main and necessary basis for criminalizing negligence. The author focuses attention on the harm that this crime causes to public relations. The necessity of strengthening criminal liability for negligence by the legislator is argued for.
