Social Media as Evidence: Legal Risks and Protective Guarantees in the Russian Context

The article examines the legal aspects of using social media data as evidence in terms of legal risks and safeguards in Russia. It analyzes the contradictions between the pursuit of personal data protection and the need to ensure access to electronic evidence for the administration of justice. Special attention is paid to the differentiation of the legal regimes governing open and closed accounts, as well as the role of consent in the processing of personal data. In conclusion, the author substantiates the necessity of legislative formalization of the definitions of «social network» «open/closed account» and formulates practical recommendations for legal professionals on handling digital evidence.
