The article considers the subject’s mental attitude to illegal establishment (creation, reorganization) of a legal entity. The author estimates intellectual issues and volition of subjective side of the mentioned activities. The cases from court practice proving the problem of purpose in the subjective side of the crime provided for by Article 1731 of the Criminal Code of the Russian Federation are under study.
