The article analyzes the issues surrounding obtaining consent to search a dwelling within the context of Russian criminal procedural law. It examines the practical implementation of the right to inviolability of the home during searches conducted with the consent of the occupants. The study investigates judicial practices regarding who can consent to a search and under what circumstances, as well as the various forms such consent exist. Specific legislative amendments are proposed aimed at strengthening the protection of the right to inviolability of the home. These include clarifying the categories of individuals authorized to give consent for a search and advocating for the necessity of obtaining written consent if oral consent is not documented by technical means or confirmed by witnesses.
