Questionable terms that should be considered when qualifying of "new potentially dangerous psychoactive substances"

Dedicated to the relatively recently introduced Art. 234.1 of the Criminal Code of the Russian Federation, which causes controversial issues in investigative and judicial practice. It is noted that, due to the lack of explanation when comparing the concepts of “drugs”, “psychotropic substances” and “new psychoactive substances”, the use of this norm is very rarely used by law enforcement officials. Attempts have been made to eliminate doubts about the qualification of these concepts. As conclusions, positions have been identified that speak about the decriminalization of this article and will allow the preliminary investigation authorities not to exceed their official powers in qualifying a specific norm on illicit trafficking in narcotic drugs and psychotropic substances.
