Improvement of legal regulation of contingent labour in Russia

Introduction: by the end of the 20 th century contingent labour as a specific socio-legal technology began to be used around the world. Today, this type of alternative labour relations is common in Russia. However, in Russian law there are no special rules on contingent labour. Purpose: to study the current state and prospects of legal regulation of contingent labour in Russia. Methods:the methodological framework of this study is based on a set of methods of scientific cognition, among which the main ones are systemic and comparative law methods. Results: considering experience of foreign countries, the author analyzes the concept of contingent labour in correlation with the concepts of temporary employment, employee leasing, outsourcing and so-called outstaffing. According to the results of the comparative analysis, outstaffing is concluded to be the least socially acceptable form of contingent labour, since it often leads to abuse of rights in the sphere of tax and other types of relations. However, proper putting outstaffing under a ban through law, without recognizing contingent labor as a whole as an illegal phenomenon, seems to be a difficult technical problem. Furthermore, the author provides a general analysis of the Federal Law of 05.05.2014 № 116-FZ, which is supposed to bring contingent labour under regulation and define the legal status of private employment agencies in Russia. Conclusions: on the whole, the author evaluates the Federal Law of 05.05.2014 № 116-FZ positively, but is critical of some ambiguities and excessive restrictions. In particular, it is noted that restrictions on the use of contingent labour should not impede the development of outsourcing in business.
