The article reflects the problem questions of application of release from punishment in connection with a change in situation. The author suggests the algorithm for determination of the fact of change in situation and gives definitions of such notions as « situation», «change in situation», «lapse of person's social danger in connection with a change in situation», «lapse of social danger of a crime as a result of change of the situation». The main conclusions and proposals are confirmed by questioning of law enforcement professionals and criminal cases study.
