Justice and Equality – Large Segments of the Russian Mentality: Criminal Procedure Aspect

Justice and equality before the law are not just abstract concepts, but fundamental values deeply rooted in the Russian mentality. Historically, the desire for truth and rejection of arbitrariness form the public con-sciousness that demands impartial and fair resolution of conflicts, especially within the framework of criminal pro-ceedings. Criminal procedural legislation, in turn, is a tool for the realization of these values. The principle of equality of all before the law is aimed at creating conditions for the objective consideration of a case and the delivery of a fair verdict. In the context of reforming the criminal procedural legislation of the Russian Federation, special attention should be paid to strengthening the principles of justice and equality. These concepts, deeply rooted in the Russian mentality, should be reflected in the norms of the Criminal Procedure Code of the Russian Federation. In this regard, to raise the question of the need to enshrine in the provisions of the CPC of the RF the principles of equality and fairness in order to achieve the objective truth. These measures will ensure the realization of equal rights and opportunities for all participants in criminal proceedings, regardless of their social status, property status or other factors. The realization of the principle of fairness requires not only compliance with procedural norms, but also consideration of moral and ethical aspects. The trial must be fair not only from the point of view of the law, but also from the point of view of public morality. Only in this case it is possible to talk about the achievement of objective truth and delivery of a lawful and justified verdict.
