A comparative legal analysis of the land lease agreements in Russia and China

The article presents the results of a comparative legal analysis of the land lease agreements in the People's Republic of China and the Russian Federation. The authors emphasize the relevance and ignorance of this issue. It is concluded about the content of an agreement and the rights and obligations of its parties. The study notes that the main aspect of the differentiation in practical application of an agreement is the economic, social and political system. The article defines either similar or specific features of the land lease agreements in the abovementioned countries, as well as reveals their advantages and disadvantages. A number of distinctive features of a land lease agreement in the Russian Federation argue that the Russian legislation is liberal in terms of providing opportunities for full realization of the rights and obligations of an agreement parties. A land agreement in the People's Republic of China is characterized by the lack of equality between the subjects of an agreement, the limited range of its possible subjects or parties, the existence of strict criteria and limits for the conclusion of an agreement.
