The grounds of suspended sentencing application under the criminal laws in Russian Federation and Mongolian people's republic

This article examines the grounds of the suspended sentencing (or probation as a part of it) application and practice under the criminal laws in Russian Federation and Mongolian People’s Republic. The materials of the research were the Criminal Codes of the Russian Federation (further UK RF) and Mongolia, previous scientific works and studies in the criminal law field, publications reflected in journals highlighting the problems of the use of suspended sentencing (probation), data posted on e-resources, materials of judicial practice focused on this topic. Highlighted the problematic issues of law enforcement; studied the existing grounds for the application of suspended sentencing (probation) under the Criminal Laws of Russia and Mongolia; analyzed the judicial practice of the use of suspended sentence (probation). The analysis of suspended sentencing (probation) application allowed to formulate the effectiveness of this measure of criminal law and the shortcomings of its enforcement.
