The Formation of the Russian Legal Institute of the Pre-Trial Cooperation Agreement Through the Prism of the Norms of Historical Legal Monuments of Russia

In the work, the author establishes the relationship between the institution of a pre-trial cooperation agreement and the norms contained in the legal monuments of Russia, which stimulate positive post-criminal behavior of a person who has committed a crime, and also identifies the prototypes of the creation of the institution of a pre-trial cooperation agreement in Russian law. The article pays attention to such historical legal monuments as Russian Truth, the Judicial Code of 1550, the Cathedral Code of 1649, the Military Article of 1715, the Code of Criminal and Correctional Punishments of 1845, the Code of Criminal and Correctional Punishments of 1885, the Statute on Punishments imposed by Magistrates of 1864, the Code of Criminal Procedure RSFSR 1923, Criminal Codes of the RSFSR 1922, 1926, 1960. The study examines the mitigating circumstances associated with the positive post-criminal behavior of the perpetrator, as well as the rules for sentencing when establishing such circumstances, which were contained in the above-mentioned legal documents, and also examines the individual features of the institution of a pre-trial cooperation agreement in accordance with the norms of current legislation.
