Employer’s liability insurance as a non-judicial way of labor rights protection: the current state and the prospects for legislative development

A significant number of violations of labor rights of employees and employers forced to search for new additional ways of effective labor rights protection, justifying their subsequent introduction to the labor process. In particular, as one of the non-judicial ways to protect labor rights, it is proposed to adopt the compulsory insurance of employer’s liability for certain insurance risks (the author models not only these risks but also the procedure for their application), and in other cases it is offered to implement the voluntary employer’s liability insurance. The author concludes that this type of insurance is an optional non-judicial way of protecting labor rights which establishment and implementation become an interest of the employee, the state, and the employer.
