Subsidiary liability of persons controlling the debtor outside the bankruptcy case

The article deals with the possibility of bringing the debtor's controlling persons to subsidiary liability outside of the insolvency (bankruptcy) procedure, which is regulated by law. The author analyzes and correlates Federal laws № 488-FL of December 28, 2016 and № 266-FL of July 29, 2017, identifies the specifics of bringing managers and other controlling persons to subsidiary responsibility, and suggests ways to resolve disputes.
